TERMS & CONDITIONS
§ 1 Scope
These Terms and Conditions apply to all contracts between Bay und Co. GmbH (hereinafter ‘Cocktail X Catering’) and the client for the provision of catering services.
§ 2 Contract Formation
A contract is formed upon written confirmation of the offer by the client. Offers from Cocktail X Catering are non-binding unless expressly stated otherwise.
§ 3 Scope of Services
The scope of services is defined by the respective offer or order confirmation. Changes to the scope of services require written agreement by both parties.
§ 4 Prices & Payment
All prices are net plus statutory VAT. A deposit of 50% is due upon order confirmation. The remaining balance is payable within 14 days of the event.
§ 5 Cancellation
Cancellation up to 30 days before the event incurs a charge of 25% of the order value. Up to 14 days before: 50%, thereafter: 100% of the agreed price.
§ 6 Liability
Cocktail X Catering is only liable for damages caused by intentional or grossly negligent conduct. Liability is limited to the order value.
§ 7 Final Provisions
The law of the Federal Republic of Germany applies. Place of jurisdiction is Munich. If any provision of these terms is invalid, the validity of the remaining provisions remains unaffected.
